Rental Agreement

Deposit: To reserve your time and date a $100 non-refundable fee is required*.
The remainder of the payment is due upon Desert Express Train arriving at the
event.

Payment Options: Desert Express Train accepts all major credit cards,
checks, and cash. Credit card payments can be placed over the phone. Checks
made out to Desert Express Train can be mailed to:

*Weather Cancellation Policy: In the case of event cancellation due to reasonable
and acceptable foul weather, any payment made by the customer will be fully
refunded if canceled 2 hours in advance of the event. If the event is canceled after
Desert Express Train leaves for the event the initial fee becomes non-refundable.
Insurance: Desert Express Train is fully insured and Certificate of Liability is
provided upon request. Please let us know as soon as possible if we need to list
your city and/or company as an additionally insured.

Permits: Some cities, parks or HOA companies require a special permit for us to
run. It is the renter’s responsibility to secure any required park or other permits to
allow the train to operate at the event. Desert Express Train is happy to provide any
proof of insurance required to obtain the permit. If permits are not obtained by the
renter, and the train is not allowed to operate according to city, park, HOA or
company officials, the full event price will be retained by Desert Express Train and
will not be refunded in whole or in part.

Photos/Video: When hiring our services you are consenting to allow Desert
Express Train to take photos and video (including audio) of the event, including you
and your guests likeness’ for the expressed purpose of using the material in online
and print advertising and marketing as deemed necessary by Desert Express Train.
Any and all recordings belong to Desert Express Train.

Food and Drink: For safety reasons, no food or drink is allowed while enjoying the
train unless specifically permitted by the engineer.
Hold Harmless: Event coordinator and/or affiliates and guests agree to indemnify
and hold harmless Desert Express Train and Myers Holdings, LLC from any and all
claims, actions and judgments, including costs of defense attorneys fees incurred in
defending against same, arising from and related to event coordinator, affiliates, and
guests use of the train and equipment except in the case of gross negligence by
Desert Express Train or its employees.

Train Rules: Following the safety rules will ensure that everyone has fun!
1) No standing or removing lap belt while train is moving.
2) No boarding the train unless train is stopped.
3) No touching or chasing the moving train.
4) No jumping into or out of train.
